OSHA's Annual Requirements for the Posting of Work-Related Injuries Log

As we do at the beginning of each new year, we'd like to remind you of OSHA's annual requirement that you post your Summary of Work-Related Injuries and Illnesses for the calendar year 2009. Some of the key items related to these requirements are highlighted below:
- The required posting period is three months (February 1 through April 30).
- In addition to the 300A, you must also maintain the OSHA 300 and 301, as well as a Privacy Cases Log.
- A company executive must certify the accuracy of the data reported on the log.

On November 9th, Insurance Commissioner Steve Poizner approved the following changes effective January 1, 2010 to the California Workers' Compensation Experience Rating Plan (ERP):
• Expected Loss Rates (ELR) have been enhanced to reflect current statewide trends within the North American Industrial Classification System
• The Experience Rating formula has been modified to utilize a "single split" approach to segregate claims into their primary and excess components
• The ERP credibility values ("B" and "W") have been revised

A new set of reporting requirements for insurance claims took effect on July 1, 2009, mandating a complex reporting process with serious consequences for non-compliance. The new regulations will for the first time require insurers and certain employers to report settlements, awards, and judgments on all liability, workers' compensation, and no-fault automobile claims involving a Medicare beneficiary.

On January 1, 2009, Assembly Bill 2738 went into effect. This bill impacts the contractual risk transfer between residential owners, builders, general contractors and their subcontractors.
